Cancelling German telecom contracts: the rules tilted your way

By Covered Abroad Research Desk · Last verified July 2026

German phone and internet contracts run on § 56 of the Telekommunikationsgesetz (TKG): the initial term of a consumer contract may not exceed 24 months, and once a contract silently renews past that initial term, you can cancel at any time with one month's notice. Providers must also warn you on a durable medium before the renewal happens. The days of being trapped in a second full year because you missed a cancellation window are over — for telecoms.

The two rules that matter

Both sit in TKG § 56. First: die anfängliche Laufzeit eines Vertrages… darf 24 Monate nicht überschreiten — the initial term of a consumer telecom contract may not exceed 24 months. Second: where a contract silently renews after that initial term, kann der Endnutzer einen solchen Vertrag… jederzeit unter Einhaltung einer Kündigungsfrist von einem Monat kündigen — cancellable at any time on one month's notice. No anniversary windows, no year-two lock-in.

The warning the provider owes you

§ 56 also obliges the provider, before a renewal, to inform you auf einem dauerhaften Datenträger — on a durable medium — of the silent renewal and your cancellation options. In practice that's the email or letter that arrives near the end of your initial term; it's the legally-mandated cue to act, not marketing. Cancel in text form, keep the confirmation, and time the switch so your number ports cleanly.

Leaving Germany: the paper trail

These rules cover telecom contracts; other German subscriptions follow their own consumer-contract regimes, so check each contract's terms individually. On a move abroad, cancel telecoms in writing with your leaving date, and pair the sweep with the rest of the unwind: the Rundfunkbeitrag deregistration and a Nachsendeauftrag so final bills and confirmations still reach you. Unreturned routers are the classic parting invoice — send the hardware back tracked.

Common questions

Can I cancel my German phone contract monthly?

After the initial term auto-renews, yes — TKG § 56 makes renewed contracts cancellable at any time with one month's notice. During the initial term (max 24 months) you're bound unless a special right applies.

What's the maximum contract length in Germany?

For consumer telecom contracts, the initial term may not exceed 24 months under TKG § 56. Shorter 12-month offers exist — compare the effective monthly price.

Does this apply to gym memberships too?

No — § 56 covers telecom services. Other subscription types run on separate consumer-contract rules, so read those contracts individually.

Can I cancel early if I move abroad?

Moving abroad doesn't automatically end a telecom contract — special cancellation rights depend on whether the provider can still serve you. Cancel in writing early and ask the provider to confirm the end date.
