The PACS: France's civil partnership, and how foreigners conclude one

By Covered Abroad Research Desk · Last verified July 2026

The PACS — pacte civil de solidarité — is open to couples of the same or different sex, whatever your nationality, per service-public. It's a contract (convention) signed by both partners organising your life together, registered free of charge at the mairie of your common residence — or, if you live abroad, at a French embassy or consulate — with a paid notaire route as the alternative. It is not marriage: different institution, different effects, same office.

What the PACS is — and who can conclude one

Service-public's fiche states the opening rule: you can conclude a Pacs whether of the same sex or different sexes, and whatever your nationality. Legally it is a contract, also called a convention, signed by the two of you, organising your common life — contribution to shared costs and the rest. The fiche's situation-driven flow covers the cases that complicate foreign files: one partner foreign, refugee status, prior marriages (divorced or widowed), and protection measures.

Where it's registered — three doors

Per the fiche: registration is free at the mairie — the one of your (future) common residence, with procedures varying slightly by commune; at a French embassy or consulate if you reside abroad; or through a notaire, which is the paid route. For mixed-nationality couples the file grows civil-status documents from the foreign partner's country — the place where apostilles and sworn translations enter, and where starting document collection early pays.

PACS vs marriage — the honest comparison frame

The two institutions share an office and differ in law: marriage carries the full civil-status apparatus (and its own fiche family — our French marriage guide); the PACS is contractual, faster to conclude and to dissolve, with its own tax, property and inheritance consequences that differ from marriage's. Two boundaries worth naming without straying into advice: a PACS does not by itself confer French nationality or a residence right — the immigration effects run through the residence-permit rules — and inheritance positions differ sharply from marriage, which is succession-regulation territory and a notaire conversation.

Common questions

Can two foreigners conclude a PACS in France?

Nationality is no barrier — the fiche says whatever your nationality. The registration door depends on residence: mairie of your common residence in France, consulate if you live abroad, or a notaire.

Is the PACS free?

At the mairie (and at consulates), registration is free; the notaire route is paid. Foreign civil-status documents with apostilles and translations are the real cost line for mixed couples.

Does a PACS give residence rights in France?

Not by itself — immigration effects run through the residence-permit framework, where a PACS is a fact the file considers, not a permit. Plan the residence question separately.

PACS or marriage — which should we choose?

Different legal institutions with different property, tax and inheritance consequences — the comparison is personal and, for cross-border couples, notaire territory. Our marriage and succession guides map the descriptive side.
