Spain's tourist-rental registration: what stands after the Supreme Court
By Covered Abroad Research Desk · Last verified July 2026
What the decree built
Per the BOE's consolidated text, the registration procedure yields un número de registro único assigned to each property (or separately rented unit), sin el cual no podrá llevarse a cabo su oferta en las plataformas en línea de alquiler de corta duración — no number, no listing. The single-registry procedure sits in the Registro de la Propiedad (and Bienes Muebles where relevant), and the Ventanilla Única Digital de Arrendamientos — housed at the Housing Ministry — is the national digital gateway for data exchange between short-term rental platforms and the authorities, implementing Regulation (EU) 2024/1028.

What the Supreme Court struck
The consolidated text now carries the scars. Per the BOE's own annotations: letters f), i) and j) of the definitions article were annulled — f) and i) by the Supreme Court judgment of 19 May 2026 (Ref. BOE-A-2026-12300), with the judgment of 21 May 2026 (Ref. BOE-A-2026-13893) pronouncing in the same sense on f) and i) and, as regards the mentions made of the Registro Único de Arrendamientos procedure and the registration number, on letter j); a further judgment of 1 June 2026 followed. The consolidated text has been re-published repeatedly since (modifications of 8 June, 26 June and 18 July 2026).

Descriptive guidance only — this page touches no tax and gives no legal advice. Three stable facts: the EU-level data obligation (Reg 2024/1028) exists independently of the Spanish litigation; the BOE consolidated page is the single honest source for what currently stands, with a version picker per amendment date; and the platforms' own listing requirements are where the rules bite in practice. Anyone buying property in Spain to let short-term should read the current consolidated text and their comunidad autónoma's tourism rules — the regional licence layer predates and survives all of this — before modelling any rental income.
