Lost, damaged or delayed baggage: the airline's liability, decoded

By Covered Abroad Research Desk · Last verified July 2026

Per the Commission's air passenger guidance, if your checked-in luggage is lost, damaged or delayed, the airline is liable and you're entitled to compensation up to approximately €1,300 — unless the damage came from an inherent defect in the baggage itself. The deadlines decide everything: claim in writing within 7 days, or within 21 days of receiving your luggage if it was delayed. For hand luggage, the airline is liable only if it caused the damage.

The liability ceiling — and its exclusion

The Commission's air passenger rights page states it plainly: for checked-in luggage that is lost, damaged or delayed, the airline is liable and you're entitled to compensation up to an amount of approximately €1,300. The built-in exclusion: if the damage was caused by an inherent defect in the baggage itself, you're not entitled to any compensation. Hand luggage runs on a different footing — the airline is liable for damage to it only if the airline was responsible.

The deadlines that kill late claims

Per the same guidance, a claim for lost or damaged luggage must be filed in writing to the airline within 7 days, or within 21 days of receiving your luggage if it was delayed — and there is no standard EU-wide form, so the airline's own claims channel is the route. The calendar is the whole game: the PIR reference you get at the airport desk is not a claim; the written submission inside the window is.

Travelling with more than €1,300 in the bag

Two honest options from the same page for expensive contents: you can, for a fee, request a higher compensation limit from the airline you are travelling with — in advance and at the latest when you check in; and the Commission's own advisory is that to ensure you have sufficient coverage when travelling with expensive items, it's advisable to hold travel insurance. Movers hauling a life across borders usually pass the ceiling without noticing — declare, insure, or carry the irreplaceable in the cabin.

Common questions

How much compensation for delayed baggage in the EU?

The same liability ceiling applies as for loss and damage — up to approximately €1,300 for checked luggage — and the delayed-bag clock gives you 21 days from actually receiving the luggage to claim in writing.

Is there an EU form for baggage claims?

No — per the Commission's guidance there is no standard EU-wide form. File in writing through the airline's claims channel, inside the 7-day (loss/damage) or 21-day (delay) window the same guidance sets out.

The airport gave me a PIR reference — am I done?

Treat the PIR as the report, not the claim. The written claim to the airline within the deadline is what preserves your right to compensation.

My laptop was in the checked bag — fully covered?

Only up to the roughly €1,300 ceiling across the whole bag, unless you declared a higher value at check-in for a fee. High-value contents are what the higher-limit declaration and travel insurance exist for.
