The Package Travel Directive: what a "package" legally buys you

By Covered Abroad Research Desk · Last verified July 2026

Directive (EU) 2015/2302 attaches rights to packages that stand-alone bookings never carry: the organiser is liable for the performance of the travel services in the package, and you're protected against organiser or retailer insolvency. A price increase above 8% of the total lets you terminate without a fee, and unavoidable and extraordinary circumstances significantly affecting the package — war, terrorism, disease outbreaks, natural disasters — allow free termination too.

What counts, and what the package guarantees

Per the Commission's Your Europe guidance, package rights cover the performance of travel services included in your package and insolvency protection, whether bought online or face-to-face, from a tour operator, travel agent or any trader acting as the organiser. The same guidance draws the boundaries: more limited rights apply to linked travel arrangements, and the rules do not cover stand-alone travel services — a flight booked alone lives under EU261, not this directive.

The 8% price line

Directive 2015/2302 handles the post-booking price hike directly: if the organiser proposes a price increase of more than 8% of the total price, the traveller should be entitled to terminate the package travel contract without paying a termination fee. Below that line, permitted increases follow the contract's own rules; above it, the exit is free and the choice is yours.

Free cancellation when the world intervenes

The directive also lets the traveller terminate without paying any termination fee where unavoidable and extraordinary circumstances will significantly affect the performance of the package — its own examples: warfare, other serious security problems such as terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters. Note the test is significant effect on the package's performance, not general nervousness about a destination — and note, as ever, that these rights refund your package, not your medical bills abroad: health cover is a separate policy.

Common questions

Is my flight-plus-hotel booking a package?

If one trader sold it as a combination — including online checkouts that bundle — package rights generally attach. A flight alone or hotel alone is a stand-alone service outside the directive; linked travel arrangements sit in between with more limited rights.

What happens if my tour operator goes bankrupt?

Insolvency protection is one of the directive's two headline guarantees — organisers must be covered so that travellers are protected against their insolvency. Who provides that protection is a national implementation detail shown in your contract's standard information.

Can the organiser raise the price after I book?

Only within the contract's terms — and if the proposed increase tops 8% of the total, the directive entitles you to walk away without a termination fee.

Does the directive replace travel insurance?

No. It binds the organiser on performance, price and insolvency; it pays no hospital bills and covers none of your own cancellation reasons. Health cover for the trip — or the move — is separate, and it's the part we arrange.
